Lending hens and eggs in lieu of chicks which will hatch in the future

Question

Assalam Alaikum

A person lends another person some hens and the eggs with a condition to receive a fixed portion of young chicks from future growth. Is this permissible or not?

Answer

الجواب حامدا ومصليا ومسلما

The aforementioned method of transaction does not comply with shari’ah for the following reasons: When a transaction involves any type of exchange, it is necessary that the exchange is known and existent at the time of the transaction. These two conditions are not present in the following transaction. The hens are not in existence at the time of transaction nor is it known if the specified amount of eggs will hatch or not. Therefore, such a transaction would not be permissible.
